General Conformity Statement to Consumer Product Safety Act of 2008 (CPSIA)

Pennsauken, NJ, September 16, 2009 – Disc Makers, the leading independent CD and DVD manufacturer issues a General Conformity Statement regarding its compliance status in relation to the CPSIA Act of 2008.

Disc Makers has been working aggressively with industry partners, legal and safety specialists, our suppliers, and our customers in an effort to meet the applicable compliance requirements as specified in the Consumer Product Safety Improvement Act of 2008 (CPSIA) that was signed into law effective August 2008. As a result of this newly enacted legislation there are both certification and testing requirements specified for children's products, toys and child care articles. On January 30th 2009 the CPSC issued a Stay of Enforcement of the new legislation for one year for many products.

Although it is unclear whether Disc Makers products fall under this regulation, it has nonetheless endeavored to have its products tested for compliance. Audio and Video Labs Inc. manufactured and distributed products have completed testing for compliance / certification as a “Children's Product” defined specifically by the CPSIA as a “consumer product designed or intended primarily for children 12 years of age or younger”. The testing was completed on a wide matrix of products and packaging configurations selected to ensure that all potential product configurations will be covered via the certification results. All testing has been completed in conjunction with CSPC approved third party laboratories and the results indicate that each of the aforementioned products meet all of the surface lead and internal lead content thresholds as defined in the CPSIA Act of 2008.

In parallel with this testing Disc Makers is also working very closely with our supply chain partners to verify that the consumables and raw materials utilized in our final product configurations are below the CPSIA-specified limits for surface and internal lead. Please note that the aforementioned compliance requirements and disclosure only pertain to products manufactures from this date forward.

Please note that the CPSIA also require Disc Makers to verify that all customer supplied materials will meet the requirements as defined in the CPSIA of 2008. Based on this requirement all new submissions of customer supplied materials that are intended for children 12 years of age or younger can only be accepted for use if the customer provides a copy of the conformity certificate for each item submitted.
